NOTICE: Under the relevant legislation, please print the agreement below in bold 16-point type and read it. Every customer who registers on our website and makes a purchase is also deemed to have read and accepted all the provisions of the sales agreement below without further notice.

DISTANCE SALES AGREEMENT

This agreement has been drawn up pursuant to the requirement to conclude an agreement for online sales under the Regulation on the Procedures and Principles for Implementing Distance Contracts, published in Official Gazette No. 25137 of 13 June 2003. Its provisions are set out below.

ARTICLE 1 — SUBJECT

This agreement covers the rights and obligations of the parties regarding the sale and delivery by the SELLER to the BUYER of the product whose specifications and sales price are stated below, pursuant to Consumer Protection Law No. 4077 and the Regulation on the Procedures and Principles for Implementing Distance Contracts.

ARTICLE 2.1 — SELLER INFORMATION

Rekor Sanat

ARTICLE 2.2 — BUYER INFORMATION

The customer is the person who registers on www.rekorsanat.com.tr as a member of the shopping website.
The address and contact details provided during registration shall be used.

ARTICLE 3 — INFORMATION ABOUT THE PRODUCT COVERED BY THE AGREEMENT

The type, quantity, brand/model, colour, number of units, sales price and payment method of the goods/product/service are as recorded when the order is completed.

ARTICLE 4 — GENERAL PROVISIONS

4.1 — The BUYER declares that they have read and understood all preliminary information on the essential characteristics, sales price, payment method and delivery of the product or products specified in Article 3, and have provided the required confirmation electronically.

4.2 — Each product covered by the agreement shall be delivered to the BUYER or the person/organisation at the specified address within the period stated in the preliminary information, depending on the distance to the BUYER’s place of residence, without exceeding the statutory period of 30 days. This period may be extended by no more than 10 additional days, provided the BUYER is notified in advance.

4.3 — If the product is to be delivered to a person or organisation other than the BUYER, the SELLER shall not be held responsible if that recipient refuses delivery.

4.4 — The SELLER is responsible for delivering the product intact, complete and in accordance with the specifications stated in the order.

4.5 — Delivery requires the SELLER to have received a signed copy of this agreement and payment through the method chosen by the BUYER. If the price is not paid for any reason, or the payment is cancelled in the bank’s records, the SELLER shall be deemed released from the obligation to deliver the product.

4.6 — If, after delivery, the relevant bank or financial institution does not pay the SELLER because the BUYER’s credit card was used unfairly or unlawfully by unauthorised persons through no fault of the BUYER, the BUYER must return the product to the SELLER within 3 days, provided it has been delivered to them. In this case, the BUYER bears the shipping costs.

4.7 — If the SELLER cannot deliver the product on time because of force majeure or extraordinary circumstances such as adverse weather preventing transport or transport interruptions, the SELLER must inform the BUYER. The BUYER may then cancel the order, request an equivalent replacement if available, and/or postpone delivery until the impediment is removed. If the BUYER cancels the order, the amount paid shall be refunded in cash and in a single payment within 10 days.

4.8 — This agreement becomes effective when the BUYER clicks to confirm that they have read and accepted it.

ARTICLE 5 — RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw within (7) days after delivery of the product to them or to the person/organisation at the address they specified. To exercise this right, the BUYER must notify the SELLER by fax, email or telephone within that period, and the product must be unused under the relevant provisions. A copy of the shipping receipt showing that the product delivered to the BUYER or a third party has been sent to the SELLER, together with the original invoice, must be returned. The price shall be refunded within 10 days after these documents are received. If the original invoice is not sent, VAT and any other statutory charges cannot be refunded. The SELLER bears the shipping costs of a product returned under the right of withdrawal.

If payment is made by credit card or a similar payment card, the consumer may request cancellation on the grounds that the card was used unlawfully and without their consent. In that case, the card issuer shall refund the payment to the consumer within 10 days after being notified of the objection.

For disputes arising from this agreement, Consumer Arbitration Committees have jurisdiction up to the value announced by the Ministry of Industry and Trade, and the Consumer Courts at the SELLER’s place of residence have jurisdiction.

By completing the order, the BUYER is deemed to have accepted all the terms of this agreement.
